Preamble and identity of the provider

Subject of the contract

These General Rental Terms (hereinafter the "Terms") govern the contractual relationship between LOOPCAR SAS (hereinafter "LOOPCAR" or "the Lessor") and any natural or legal person (hereinafter "the Customer" or "the Renter") booking a vehicle on the loopcar.fr website.

Any booking implies full and unreserved acceptance of these Terms. The Renter acknowledges having read the Terms prior to confirming the booking and having had the necessary time to review them. These Terms prevail over any other document, in particular any general terms of purchase issued by the Renter.

The specific conditions applicable to each rental (vehicle, dates, place, mileage, protection plan, amounts) are summarised in the confirmation email and on the inspection report signed at the time the vehicle is handed over. In the event of any discrepancy between the French version and any translation, the French version shall prevail.

Definitions

Glossary

"Vehicle": the motor vehicle leased to the Renter under these Terms, identified by its licence plate and VIN on the inspection report.

"Rental Period": the period between the date and time the Vehicle is handed over to the Renter and the date and time it is effectively returned to the Lessor, as set out in the booking confirmation.

"Primary driver": the natural person who made the booking, whose details and driving licence are registered at booking. Only the Primary driver and any declared Additional drivers are authorised to drive the Vehicle.

"Protection plan": the level of damage cover selected by the Renter among the four available tiers (No protection, Basic, Intermediate, Full), which determines the maximum deductible borne by the Renter in case of claim.

"Deposit": the bank pre-authorisation placed on the Renter's card at vehicle handover, equal to the deductible of the Protection plan selected.

"Claim": any event damaging the Vehicle or involving a third party (accident, impact, scratch, glass breakage, partial or total theft, vandalism, fire).

Booking

Booking process

Bookings are made exclusively online at loopcar.fr. The Renter selects the Vehicle, the dates and times, the delivery and return location, the Protection plan and any optional extras.

The booking is firm and final upon validation of the full payment by credit card and the issuance by LOOPCAR of a confirmation email comprising a full summary, the pro-forma invoice and a link to these Terms in the version applicable to the booking.

Primary and Additional driver requirements

The Primary driver and any Additional driver must be at least 21 years old on the handover date and hold a driving licence in force for at least one (1) year.

Any Additional driver must be declared no later than at vehicle handover, present documents in person to the Lessor's representative and sign the inspection report. Declaration of an Additional driver gives rise to a surcharge of ten euros (€10) per day of rental.

Any person under guardianship, conservatorship or equivalent legal protection measure may not act as Renter or driver. The Lessor reserves the right to request any document establishing the Renter's full legal capacity.

Accepted driving licences

Any national driving licence in force is accepted, provided the driver may legally drive on French territory in light of international agreements and length of stay. Licences written in a non-Latin alphabet (Cyrillic, Arabic, Chinese, Japanese, etc.) must be accompanied by a sworn official translation or a valid International Driving Permit.

Failing presentation of a valid and compliant licence at handover, the Lessor will be entitled to refuse handover of the Vehicle under the conditions set out in the article on the right of refusal.

Documents required at handover

The following must be presented in original and in force, at the latest at vehicle handover: (i) the driving licence of the Primary driver and of each Additional driver, (ii) an identity document (identity card or passport) in the name of the Primary driver, (iii) the credit card in the name of the Primary driver intended for the Deposit pre-authorisation.

No copy, photocopy or picture of a document is accepted. Failing the above, the Lessor may refuse handover of the Vehicle under the conditions set out in the article on the right of refusal.

Pricing and payment

Pricing

Rates are expressed in euros, all taxes included, and shown to the Renter before booking validation. Included in the rate are: the provision of the Vehicle for the Rental Period, delivery and pickup in the free delivery zone (Nice Côte d'Azur airport Terminals 1 and 2, Nice-area SNCF stations, and any address within a 20-kilometre radius from the centre of Nice), mandatory third-party liability insurance and comprehensive insurance with deductible, the daily mileage allowance set out in the Mileage article, and 24/7 assistance.

The Protection plan subscribed by the Renter is billed separately at the daily rate shown at booking. The daily rate of the Protection plans is dynamic and varies according to the Vehicle and the rental duration; it is expressly accepted by the Renter upon booking confirmation.

Additional fees may be billed during or after the rental in accordance with these Terms: excess kilometres, missing fuel or energy, late return, exceptional cleaning, road traffic offences, damage exceeding the cover of the Protection plan, administrative handling fees.

Payment terms

Payment is made in full, in a single instalment, upon booking confirmation, by credit card (Visa, Mastercard, American Express) via the secure payment provider Stripe. No deposit or instalment payment is offered: the total amount is charged at booking confirmation.

A final invoice is sent to the Renter by email after the charge has been processed. The booking is not refundable under any right of withdrawal, in accordance with the article on withdrawal.

Deposit (bank pre-authorisation)

A Deposit is pre-authorised on the Primary driver's credit card at vehicle handover. The Deposit amount equals the deductible of the Protection plan selected by the Renter, namely: the value of the Vehicle for the "No protection" plan (capped at the expert-assessed value of the Vehicle), €1,500 for the "Basic" plan, €800 for the "Intermediate" plan and €300 for the "Full" plan.

The pre-authorisation is performed as a card hold and does not entail any immediate charge. It is fully and automatically released within a maximum of seven (7) business days from the Vehicle's return, provided no amount is owed to the Lessor (damage, offence, late return, cleaning, missing fuel, etc.).

In the event of damage or amount due, the Lessor will debit the required amounts from the Deposit up to the deductible of the selected Plan, after providing the Renter with a justifying statement (quote, photos, report). The balance of the Deposit is released within the same seven (7) business day period.

Protection plans and Renter's liability

Overview of the plans

The Renter selects, at booking, one of the four Protection plans offered. The chosen Plan determines the maximum deductible borne by the Renter in case of a covered claim, as well as the Deposit pre-authorised at vehicle handover.

Each Plan covers, up to the deductible cap, the following events: collision, scratches and impacts, partial or total theft of the Vehicle, damage to tyres, rims, windscreen and windows, interior damage (stains, burns, tears), as well as 24/7 breakdown assistance and loss or damage to keys.

"No protection" plan

No additional cover is purchased. In case of claim, the Renter's financial liability is engaged up to the residual value of the Vehicle as assessed by an expert or by reference to the market value on the claim date.

The Deposit pre-authorised for this plan is capped at the value of the Vehicle. This plan is aimed at Renters who hold other cover (premium card insurance, personal supplementary insurance).

"Basic" plan

The Renter's deductible in case of claim is limited to one thousand five hundred euros (€1,500). The Deposit pre-authorised equals that amount. Above €1,500, damage is covered by LOOPCAR or its insurer, subject to the exclusions set out below.

"Intermediate" plan

The Renter's deductible in case of claim is limited to eight hundred euros (€800). The Deposit pre-authorised equals that amount.

"Full" plan

The Renter's deductible in case of claim is limited to three hundred euros (€300). The Deposit pre-authorised equals that amount. This plan offers the broadest cover available from LOOPCAR.

Exclusions common to all Plans

No Protection plan covers, and the Renter's full liability remains engaged, in the following cases: (i) driving under the influence of alcohol above the legal limit, of narcotics or of medication incompatible with driving, (ii) driving by a person other than the Primary driver or a declared Additional driver, (iii) non-compliant use of the Vehicle (competition, testing, paid transport, unauthorised towing, unpaved roads, etc.), (iv) breach of the prohibition on driving outside the authorised zone, (v) failure to declare a claim within the timeframes set out below, (vi) intentional damage, (vii) criminal offences linked to driving (hit-and-run, refusal to comply, etc.).

In such cases, the Renter is liable for the full cost of repairs, vehicle downtime, loss of revenue and expert fees, without any cap. Such amounts may be debited beyond the Deposit; the balance shall be recovered by any means, including judicial proceedings.

Mileage, fuel and energy

Included mileage

The rental includes a daily mileage allowance of two hundred (200) kilometres per rental day. The allowance is pooled across the total rental duration (e.g. 5 days = 1,000 km included).

Beyond the included allowance, excess kilometres are billed at the rate shown at booking and on the confirmation. The count is based on the mileage reading taken contradictorily at handover and return.

Fuel — combustion vehicles

Combustion vehicles are handed over to the Renter with a full tank. The Renter undertakes to return the Vehicle with the tank at the same level. The required fuel type (unleaded petrol, diesel) is shown on the inspection report and on the fuel cap; any fuel mistake engages the Renter's liability and gives rise to billing of drain, towing and downtime fees.

If returned with a fuel level below the handover level, the following will be billed: a flat administrative handling fee of thirty euros (€30 incl. VAT) and the missing fuel at the public price of the nearest station on the day of return, with no margin added by the Lessor.

Energy — electric vehicles

Electric vehicles are handed over with a battery level shown on the inspection report. The Renter is not required to return the Vehicle fully charged, but the battery level at return may not be lower than twenty percent (20%).

If returned with a battery level below 20%, a flat recharging fee of thirty euros (€30) is billed, covering the transfer of the Vehicle to a charging point and the corresponding operating cost.

Handover, inspection and return

Vehicle handover

The Vehicle is delivered by a representative of the Lessor at the address, on the date and time agreed at booking. Included free of charge are the following locations: Nice Côte d'Azur airport (Terminal 1 and Terminal 2), Nice-Ville, Nice-Riquier and Nice-Saint-Augustin SNCF stations, and any address within a 20-kilometre radius of the centre of Nice.

The Renter receives the exact meeting point details by SMS and/or WhatsApp approximately one (1) hour before delivery. If the Renter is unavailable at the agreed time, the Lessor will wait thirty (30) minutes; beyond that, delivery shall be deemed to have been made and the Lessor's liability discharged, without prejudice to the Lessor's right to bill the wasted-trip fee at the prevailing rate.

Contradictory inspection report

A contradictory inspection report is carried out at vehicle handover, in the presence of the Renter and the Lessor's representative, through the Lessor's digital platform (LEXIO). The following are recorded contradictorily: at least eight (8) angle photographs, fuel or charge level, mileage reading, any pre-existing damage, presence and compliance of accessories (jack, spare wheel, safety vest, warning triangle, registration document, insurance certificate).

The report is electronically signed by both parties on tablet or smartphone. A copy is immediately sent to the Renter by email. In the absence of written reservation by the Renter on the report at handover, the Vehicle is deemed to have been delivered in the recorded condition. The same process applies at return.

Vehicle return

The Vehicle must be returned on the agreed date, time and location, in a normal state of cleanliness and with the required fuel or energy level. The return is recorded contradictorily following the same process as handover. Any difference between handover and return is recorded on the report and may give rise to a Deposit debit.

The Renter remains liable for the Vehicle until the return report is signed. Leaving keys in a mailbox, at a hotel reception or with a third party does not constitute a return enforceable against the Lessor; the Renter remains bound by all contractual obligations until effective pickup by the Lessor's representative.

Late return

The Renter benefits from a thirty (30) minute tolerance beyond the agreed return time, with no additional charge. Beyond that tolerance and up to six (6) hours of delay, a flat hourly fee of fifty euros (€50 incl. VAT) per started hour applies.

Beyond six (6) hours of delay, a full additional rental day is billed at the daily rate in force, and so forth in twenty-four (24) hour increments. Any unreported delay may lead, after a notice that remains unanswered, to a report of stolen vehicle and a criminal complaint; the Renter shall bear the full financial and criminal liability.

Use of the Vehicle

General obligations

The Renter undertakes to use the Vehicle as a prudent person, in accordance with its intended use, the manufacturer's instructions, the French Road Code and the regulations applicable in the territory crossed. In particular, the Renter undertakes to comply with speed limits, to wear seatbelts, not to use a hand-held phone, and to regularly check fluid levels and tyre pressures on rentals exceeding seven (7) days.

The Renter shall immediately report to the Lessor at +33 7 56 92 21 22 any malfunction, dashboard warning, abnormal noise, loss of grip or unusual Vehicle behaviour. Failure to report engages the Renter's liability for any consequent damage.

Strictly prohibited uses

The Renter is strictly prohibited from: (i) sub-letting, lending or assigning the Vehicle to a third party, whether for consideration or free of charge, (ii) entrusting the Vehicle to any person other than a driver declared in the contract, (iii) using the Vehicle for paid transport of persons or goods (taxi, ride-hailing, professional delivery), for races, competitions, testing or sports activities, (iv) towing another vehicle or trailer without prior written authorisation from the Lessor, (v) driving on unpaved roads, beaches, tracks or any terrain not intended for normal road use, (vi) smoking or vaping inside the cabin, (vii) transporting animals without prior declaration and without proper protection (cover, cage), (viii) transporting dangerous, illicit or contrary-to-morals materials.

Any breach of the above prohibitions exposes the Renter to immediate termination of the contract without refund, billing for damage suffered by the Lessor (downtime, restoration, loss of revenue) and forfeiture of cover under the subscribed Protection plan.

Cleaning penalties

The Vehicle must be returned in a normal state of cleanliness. Failing that, the following flat penalties apply and are enforceable against the Renter, debited from the Deposit: exceptional cleaning (sand, stains, soiling) eighty euros (€80 ex. VAT), smoke smell or trace in the cabin one hundred and fifty euros (€150 ex. VAT), presence of undeclared animals one hundred euros (€100 ex. VAT).

In case of severe damage requiring restoration beyond the above flat fees (vomit, blood, paint, burns, tears), billing is based on a professional service provider's quote, plus thirty euros (€30) administrative fees, all enforceable against the Renter up to the deductible of the chosen Plan and beyond it under the Renter's personal liability.

Driving outside metropolitan France

Authorised countries

Driving the Vehicle is authorised in all countries listed on the Vehicle's International Motor Insurance Certificate ("Green Card"), subject to prior declaration to the Lessor at least forty-eight (48) hours before crossing the border and the Lessor's written consent. The Renter may request a copy of the Vehicle's Green Card at any time by emailing contact@loopcar.fr.

Driving in any country not covered by the Green Card is strictly prohibited. In case of breach, cover under the Protection plan is fully forfeited, the Renter's liability is full and unlimited for any damage, and the contract may be terminated immediately without refund.

Claims, assistance and geolocation

Claim procedure

In case of any claim (accident, impact, theft, breakdown, vandalism, fire, glass breakage), the Renter must contact LOOPCAR's assistance line immediately, and prior to any Vehicle movement, at +33 7 56 92 21 22, available 24 hours a day, 7 days a week.

Within a maximum of forty-eight (48) hours from the claim, the Renter shall: (i) send LOOPCAR by email at sinistre@loopcar.fr a duly completed accident report jointly signed with the third party or parties involved, (ii) send photographs of the Vehicle, visible damage and claim site, (iii) where an identified third party is involved, provide their full contact details and those of their insurer.

Failure to declare within the above timeframes, or incomplete declaration, results in forfeiture of cover under the Protection plan and engages the Renter's full liability for the entire damage.

Theft of the Vehicle

In case of total or partial theft of the Vehicle, the Renter shall file a police or gendarmerie complaint within a maximum of twenty-four (24) hours from the discovery of the theft and forward the original receipt to the Lessor within the same timeframe. Failing a proper complaint within this period, theft cover is fully forfeited.

Within the same timeframe, the Renter shall return the keys, registration document, insurance certificate and all Vehicle documents and accessories. Failing return of all Vehicle keys, the theft is deemed to result from the Renter's negligence and is not covered by the Protection plan.

Vehicle geolocation

The Vehicle is equipped with a geolocation device active 24 hours a day. In accordance with Regulation (EU) 2016/679 ("GDPR"), the Renter is informed that LOOPCAR processes the Vehicle's location data for the exclusive following purposes: (i) anti-theft and location in case of properly filed complaint, (ii) claim management and reconstruction of circumstances, (iii) location of the Vehicle in case of non-return after the Rental Period.

The legal basis is the Lessor's legitimate interest in protecting its assets and performing the rental contract (Art. 6.1.b and 6.1.f GDPR). Location data is kept for the duration of the rental and thirty (30) days after, then deleted unless required for litigation. The Renter has the rights of access, rectification, erasure, restriction and objection under Articles 15 to 22 GDPR, exercisable by email to contact@loopcar.fr. The Renter may lodge a complaint with the CNIL (www.cnil.fr).

Offences, fines and administrative handling fees

Transmission of fines and driver identification

In accordance with Article L.121-6 of the French Road Code, LOOPCAR, as legal representative of the legal entity holding the registration certificate, must designate the identity and address of the driver of the Vehicle on the date of any offence detected by automatic control, within forty-five (45) days from the sending of the offence notice.

Accordingly, LOOPCAR systematically communicates to the competent authorities the details of the Renter or Additional driver who was driving the Vehicle on the offence date, as recorded in the inspection report. The Renter is informed by email and receives a copy of the offence notice.

Administrative handling fees

For each fine, offence, unpaid toll notice, impound fee, irregular parking fee or any other charge attributable to the Renter that LOOPCAR pays in advance or receives after vehicle return, flat administrative handling fees of forty euros all taxes included (€40 incl. VAT) per case are billed to the Renter, in addition to the amount of the corresponding fine or fee which remains entirely the Renter's responsibility.

Such fees and amounts may be debited from the Deposit up to its amount, or billed directly to the Renter beyond it; the Renter expressly authorises the Lessor to charge the credit card used at booking.

Cancellation, modification and right of refusal

Cancellation initiated by the Renter

Cancellation more than seven (7) days before the scheduled vehicle pickup date and time: full refund of the amount paid, excluding any bank fees retained by the payment provider.

Cancellation less than seven (7) days before the scheduled vehicle pickup date and time: no refund is due; the full rental price remains the Lessor's compensation, unless the Renter purchased the Cancellation Protection at the time of booking (see paragraph below).

No-show at the agreed pickup point: no refund, regardless of the time elapsed since booking and whether the Cancellation Protection was purchased.

Cancellation Protection

The Cancellation Protection, purchased at the time of booking for an additional fee paid in advance (3.50 € incl. VAT per day, capped at 70 € incl. VAT for the entire rental), grants the following rights:

Cancellation by the Renter up to six (6) hours before the scheduled vehicle pickup date and time: full refund of the rental price, excluding the cost of the Cancellation Protection itself, which remains the Lessor's. Beyond this window (between H-6 and pickup) or in case of no-show, no refund is due.

Free modification of pickup or return dates and times up to twenty-four (24) hours before the scheduled pickup, limited to one (1) modification, and subject to vehicle availability on the requested new dates. If the new dates carry a higher price, the Renter pays the difference; if lower, a credit voucher of equivalent amount is issued, valid for twelve (12) months on LOOPCAR services. If no availability is found, the Renter retains the right to cancel within the H-6 window above.

Any request regarding the Cancellation Protection (cancellation or modification) must be sent by email to contact@loopcar.fr with the booking reference.

Cancellation by the Lessor

If LOOPCAR is unable to provide the booked Vehicle for a reason attributable to it (claim involving a previous customer, breakdown, administrative immobilisation), the Lessor shall offer the Renter, as soon as possible, an equivalent or higher category Vehicle at no extra cost.

If the Renter refuses the substitute offer, or if no equivalent or higher Vehicle is available, LOOPCAR shall refund in full the amount paid within fourteen (14) days. Save for gross or intentional fault of the Lessor, no further compensation is due.

Booking modification

Any request to modify the booking (dates, times, place, Vehicle category, Protection plan) must be made no later than forty-eight (48) hours before the scheduled handover date and time, by email to contact@loopcar.fr. The modification is subject to availability and the Lessor's written consent.

Any modification leading to an increased rate gives rise to immediate additional payment. Any modification leading to a reduced rate gives rise, at the Renter's choice, to a refund on the original payment method or to a credit note valid for twelve (12) months on all LOOPCAR services.

Right to refuse handover

The Lessor reserves the right, in the sole judgement of the on-site representative, to refuse handover of the Vehicle for serious and legitimate reasons, in particular: (i) manifest intoxication, narcotic use or physical state incompatible with driving, (ii) absence or invalidity of the required documents (licence, identity, credit card), (iii) presentation of a manifestly forged licence, (iv) driver different from the registered Renter without prior declaration, (v) threatening or insulting behaviour towards the representative.

In case of refusal on one of these grounds, the Renter is fully refunded the price paid within fourteen (14) days, except in cases of established documentary fraud (forged licence, false identity) where no refund is due and where LOOPCAR reserves the right to report the matter to the competent authorities.

Force majeure

Definition and consequences

Neither party shall be liable for any failure to perform or delay in performing its contractual obligations in case of force majeure, as defined by Article 1218 of the French Civil Code and French case law: an event beyond the debtor's control, unforeseeable upon conclusion of the contract and whose effects cannot be avoided through appropriate measures.

Such events include in particular: natural disasters, exceptional weather rendering driving impossible, general transport strikes, government restrictions, public health measures, armed conflicts, terrorist attacks. The affected party shall notify the other party as soon as possible and the parties shall seek an amicable solution; failing that, the contract may be terminated without compensation, with refund of the sums paid for the unperformed portion.

Personal data

Processing of personal data

LOOPCAR collects and processes the Renter's personal data (identity, contact details, driving licence, payment data, booking data, Vehicle geolocation data) for the following purposes: performance of the rental contract, customer relationship management, securing transactions, fraud prevention, compliance with legal obligations (in particular Art. L.121-6 French Road Code), claims and litigation management.

The legal bases are performance of the contract, legal obligation and the Lessor's legitimate interest (Art. 6 GDPR). Data is kept for the period necessary for each purpose and for a maximum of five (5) years after the end of the rental, save for longer legal retention obligations (invoicing: 10 years). Data may be shared with technical service providers (Stripe payment, hosting, Lexio platform), with insurers in case of claim, and with the competent authorities upon legal requisition.

The Renter has rights of access, rectification, erasure, restriction, portability and objection over personal data, exercisable by email at contact@loopcar.fr. The Renter is also entitled to lodge a complaint with the French Data Protection Authority (CNIL, www.cnil.fr). Full details of processing are set out in the Privacy Policy accessible from the loopcar.fr footer.

Acceptance, evidence and modification of the Terms

Electronic acceptance and evidence

Acceptance of these Terms by the Renter takes place upon booking confirmation on loopcar.fr, by activation of payment. Such acceptance constitutes an electronic signature within the meaning of Article 1367 of the French Civil Code and has, between the parties, the same evidential value as a signature on paper.

LOOPCAR retains, for each booking, the exact version of the Terms accepted by the Renter, together with the date and time of acceptance and the IP address used, for evidentiary purposes. The Renter may obtain at any time a copy of the version of the Terms applicable to their booking by simple request to contact@loopcar.fr.

Modification of the Terms

LOOPCAR reserves the right to modify these Terms at any time. The version applicable to a booking is the version in force at the booking confirmation date, as preserved by LOOPCAR. Subsequent modifications of the Terms are not enforceable against bookings confirmed earlier.

Successive versions of the Terms are dated. The version in force at the date of a new booking is brought to the Renter's attention on loopcar.fr and accepted under the conditions above.

Governing law and disputes

Governing law

These Terms and all contractual relationships between LOOPCAR and the Renter are governed by French law, to the exclusion of any other law. Reference texts include the French Consumer Code, Civil Code, Commercial Code, Road Code and Insurance Code.

Right of withdrawal

In accordance with Article L.221-28 12° of the French Consumer Code, the right of withdrawal set out at Article L.221-18 of the same code does not apply to car rental contracts to be provided on a specific date or period.

Accordingly, the Renter does not benefit from the fourteen (14) day right of withdrawal from booking confirmation, and any cancellation is subject to the conditions set out in the cancellation article.

Competent courts

Any dispute relating to the formation, performance or interpretation of these Terms and which could not be resolved amicably shall be brought before the courts having jurisdiction under the rules applicable to the consumer Renter, in accordance with Articles R.631-3 et seq. of the French Consumer Code.

The consumer Renter may, at their option, refer the dispute either to the court of the place where they lived at the time the contract was entered into or where the harmful event occurred, or to the court of LOOPCAR's registered office.
